Terms of Service.

These Terms of Service (“Terms”) govern your access to and use of kyvera.app (the “Site”), operated by HV Ventures LLC (“we,” “us,” or “our”). Kyvera is a brand of HV Ventures LLC. By accessing or using the Site, you agree to these Terms. If you do not agree, do not use the Site.

What this site is

The Site is an informational website describing Kyvera as an organization and listing apps we publish under the Kyvera brand. The Site itself does not provide a software service. Each app linked from the Site (for example, Jitterbug at jitterbug.kyvera.app) is governed by its own end-user terms and privacy policy.

Permitted use

You may access the Site for lawful, personal, and non-commercial informational purposes. You agree not to:

• Reverse engineer, scrape, or systematically copy substantial portions of the Site for republication.
• Attempt to access systems, accounts, or data you are not authorized to access.
• Use the Site to distribute malware, spam, or any content that violates applicable law.
• Frame the Site or use the Kyvera name, logo, or marks in a way that suggests affiliation, endorsement, or partnership we have not granted in writing.

Intellectual property

All content on the Site — including the Kyvera name, logo, wordmark, the “K” glyph, the visual design, text, graphics, photographs, and the structure and arrangement of those materials — is owned by or licensed to HV Ventures LLC and is protected by copyright, trademark, and other intellectual-property laws.

Nothing on the Site grants you a license to use any Kyvera or HV Ventures LLC marks. You may not use our marks, logos, or distinctive elements of our visual identity in connection with any product, service, or media without our prior written permission.

App-specific terms

When you download or use one of our apps, that app’s own terms of service and privacy policy apply to your use of the app. Where the app’s terms and these Site Terms conflict, the app’s terms control with respect to your use of that app. Current app-specific documents are linked from each app’s page.

Third-party links

The Site contains links to third-party websites (for example, the Apple App Store). We are not responsible for the content, policies, or practices of those sites. Following a third-party link is at your own risk and subject to that site’s own terms.

Disclaimer

The Site is provided on an “as is” and “as available” basis without warranties of any kind, whether express or implied, including but not limited to fitness for a particular purpose, accuracy, or non-infringement. We do not warrant that the Site will be error-free, secure, or continuously available.

Limitation of liability

To the fullest extent permitted by law, HV Ventures LLC, its members, officers, and contractors are not liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, arising from your use of or inability to use the Site, even if advised of the possibility of such damages. Our aggregate liability arising out of or relating to your use of the Site is limited to the amount, if any, you paid us for use of the Site (which is ordinarily zero).

Changes to these Terms

We may update these Terms from time to time. The “Last updated” date at the top of this page reflects the most recent revision. Material changes will be reflected by an updated date and, where appropriate, a notice on the Site. Continued use of the Site after changes take effect constitutes acceptance of the revised Terms.

Governing law

These Terms are governed by the laws of the United States and, where applicable, the state in which HV Ventures LLC is registered, without regard to conflict-of-law provisions. Disputes arising out of or relating to these Terms or the Site shall be resolved in the courts of competent jurisdiction in that state.
